The Process of Chapter 7 Bankruptcy
There are significant differences between the Chapter 7 bankruptcy process and the Chapter 13 bankruptcy process. Although each case is unique, the Chapter 7 process generally looks something like this:
- Free initial consultation: First, you will sit down with one of our attorneys to look over your financial situation and determine whether Chapter 7, Chapter 13, or some other debt-relief solution would be best in your case.
- Filing: Next, if bankruptcy is the best option for your case, we will help you prepare all of the paperwork for the initial filing with the bankruptcy court.
- Hearings with trustee: It is rare that someone filing for bankruptcy will stand before the actual bankruptcy court judge. A trustee will meet with you to carry out the various aspects of your bankruptcy proceedings. We will represent you before the bankruptcy trustee.
- Discharge: If everything is approved by the bankruptcy court, your unsecured debts will be discharged at the end of the process and you will get a fresh start. This is usually about 4 months from date of filing to the date of discharge. Each county court differs in average length of time, but the variance is small.
Chapter 7 is intended to provide debt liquidation. One benefit is that you may be able to exempt and retain all of the assets that you own, provided you can afford the payments on the secured assets and reaffirm that debt (generally a home and vehicles). Life after bankruptcy is not as bad as many people believe. You will be able to get credit again and the news of your filing for bankruptcy will not be broadcast for the world to see.
